TERMS AND CONDITIONS OF SALE

 

Article 1 - General provisions
Products’ sale offered through the website www.pulcherstore.com (hereinafter Pulcherstore) is governed by these terms and conditions of sale.
Products’ sale is only intended for individuals who are end-user consumers (hereinafter “Customers”). Customers include the individual adult who acts for purposes not related to trade, business or professional activity.
Following the above, Pulcher s.r.l. con unico socio (hereinafter Pulcher) reserves the right not to accept orders from other than the Customer.
Products are directly sold by Pulcher (see Legal notice, for data about Pulcher).
Pulcher may at any time modify or amend these Terms and Conditions. In any case, the Customer will be required to accept only the conditions in force at the time of the conclusion of each Order.


Article 2 - Proposal for a contract
To place an order the Customer must be an adult and shall be reachable by email.
The proposal sent by the Customer to Pulcher relates to the purchase of products listed and offered for sale on the site Pulcherstore.com.
Pulcher is free to accept or reject the proposal sent by the Customer, without any restriction.


Article 3 - Conclusion and effectiveness of the contract
The sale will be considered complete when Pulcher sends the Customer an email for order confirmation, except as provided in article 4 for the availability of the products.
The order confirmation email contains the details of the Customer and of the order, as communicated by the Customer, the price of the goods purchased, the cost of transport and the shipping address to which the goods will be sent. The Customer undertakes to verify the accuracy of the data contained therein and to communicate right away any correction.
Pulcher can not be held responsible in any way for incorrect data, where such data conforms to the communication sent by the Customer in the contract proposal.
The images and the colours of the products offered for sale may, in some cases, not match the actual colours due to the computer used by the Customer. The images and colours, therefore, should be considered as indicative and illustrative, but the Customer is invited to verify the adherence of the selected product to their expectations. Pulcher will not be responsible for any inadequacy of the images or colours of products due to these technical reasons.


Article 4 - Availability of products
The availability of the products refers to the moment when the customer consults the tabs of the products; this must still be regarded as purely indicative, since, due to the simultaneous presence on the site of multiple users, the products could be sold to other customers before the order confirmation.
Even after Pulcher has sent the Customer the email for order confirmation, there may be cases of partial or total unavailability of the goods. In this case, the customer will be promptly informed: he can decide whether to accept delivery of the only available products or request cancellation of the order by communicating via email to the Customer Service. No damages may be required for unavailability of ordered products.


Article 5 - Payment
PayPal, Credit card and Debit card
The payment process is handled entirely by PayPal, with its standards of security and confidentiality, and allows the Customer to pay through his PayPal account or through his credit card or debit card (subject to confirmation on the PayPal website, PayPal handles the following types of payment: PayPal, Visa, MasterCard, Debit card PayPal, Discover, American Express, and others).
Bank transfer
Bank transfer to PULCHER s.r.l. con unico socio, at Banca CR Firenze s.p.a., Agenzia 13 of Florence, IBAN IT27N0616002813100000003375.
To pay by bank transfer, the Customer submits the proposed contract by sending an email from the "Contact Us" button on the left of the homepage of the site, specifying the product he wishes to order, his data, and the address of delivery.
Orders will be processed after confirmation of payment.


Article 6 - Prices
The selling prices of the products shown on the site Pulcherstore are expressed in Euro and include VAT.
The shipping costs are not included in the selling price; they are indicated separately.
For export sales (sales outside of European Union - EU), the price shown on the site must be considered firm and non inclusive of Italian VAT. The Customer will have to care and pay for import duties and expenses. For this reason the shipment fee amount is maintained the same as intra-EU sales.
The customer accepts the right of Pulcher to modify its prices at any time without notice. Of course, the goods will be paid on the basis of the prices listed on the site at the time of the order and confirmed in the email sent by Pulcher as confirmation of the order.


Article 7 - Delivery of products
The products will be delivered by express courier, with shipment tracking and signature on delivery, considering a reasonable time for order processing. Orders are processed as soon as possible and shipped from our offices in Florence, Italy on working days.
Pulcher has the power to appoint and replace the courier at its option, at any time.
The name of the courier will be shown to the customer in the order confirmation.
The procedures for tracking order status and delivery may be available in accordance with the procedures of the appointed courier.
The absence of suitable persons to receive the products at the address indicated by the Customer may result in delays of delivery or in the Customer's obligation to collect the goods at the offices of the courier, according to his procedures. There may be even the risk that the pack will be returned to Pulcher at the Customer’s expense. These fees will then be deducted from any eventual reimbursements or refunds to the Customer. 
Pulcher does not deliver to P.O. Boxes. 
At the moment Pulcher offers international shipping to the European Union countries (EU). For other countries please contact us, sending an email from the “Contact Us” button on the left of the homepage of the web site, before making your orders, to arrange for export.
We make our best efforts to let the Customer receive the goods in 1-2 working days after the shipment has been confirmed, but these time terms are merely indicative and out of our control, and no claim may arise if, for any reason, they are not respected.


Article 8 - Complaints and warranty for products not complying
The Customer shall inspect the Products immediately upon delivery for compliance with the order. Faults (such as tampering, damaged packaging, damaged goods or goods different from those ordered and/or stated in the shipping document) must be specifically described in writing directly on the delivery note to be signed by the Customer. The Customer is obliged to immediately inform Pulcher, sending an email from the "Contact Us" button on the left of the homepage of the site, describing the event.
Product quality is strictly controlled before shipment to the Customer. In case of non-conforming goods the Customer will have the right to ask for the repair or replacement of the product, as specified in Article 130 of the Consumer Code (Legislative Decree n.206/2005).


Article 9 - Right of cancellation
In accordance with the legal provisions in force, the customer has the right to cancel the purchase without penalty and without specifying the reason, within the strict deadline of 10 working days from the date of delivery of the products.
If the Customer decides to exercise the right of cancellation, he shall send a notice by registered mail to Pulcher s.r.l. con unico socio, with headquarters in Borgo Pinti n.70, 50121 Florence, Italy or by email from the "Contact Us" button on the left of the homepage of the site. By law, the shipping costs for return of the goods shall be borne by the Customer.
The cancellation notice must contain:
1. The intention to use the right of cancellation;
2. The name of the product or products you wish to return and the amount;
3. The bank details for the transfer of refund;
4. The email address that Pulcher must use to communicate the status of the return.
The products must be returned undamaged, in their original packaging (including any documentation and accessories) with any fiscal documentation attached.
The packaging of the products is the responsibility of the Customer: each product to be returned must be properly packaged to withstand a shipment by express courier. If you no longer have the original packaging you must use an equivalent or better one.
The consignment of the product to be returned must be made to the courier within the strict deadline of 10 working days from the date of receipt of the goods. The Customer is responsible for all shipment’s risks and expenses.
Products returned non conforming to the present conditions will not be accepted and/or refunded.
If Pulcher will find compliance with the above, we will refund the amount of the products covered by the cancellation as soon as possible and within 30 days from receipt of the returned products.
Shipping fees paid for the first shipment of the goods are not refundable to the Customer.


Article 10 - Invoice upon request
Invoice will be issued when requested by the customer, not later than the time of the transaction, by email from the "Contact Us" button on the left of the page of the site, stating all the necessary data.
For the issuance of the invoice Pulcher will refer to the information provided by the Customer.
After issuing the invoice, the Customer can not request any changes to the information provided therein.
For sales out of EU invoice will be issued as far as requested by the law.


Article 11 - Validity of conditions
The contract of sale between Pulcher and the Customer shall be governed by these general conditions of purchase together with the specific directions contained in the order and in the order confirmation.
If one or more of the parties to the contract thus identified were considered to be invalid or declared as such under the law and following a decision by a court of competent jurisdiction, the other provisions shall remain in full force and effect.
For matters not expressly provided, the Italian law applies.


Article 12 - Applicable law, jurisdiction and dispute resolution.
This contract is governed by Italian law. Any dispute that can not find amicable solution will be subject to the exclusive jurisdiction of the courts of the place of residence or domicile of the customer, if located in the territory of the Italian State.
If the customer is not resident in Italian territory, the applicable law will be the Italian and the place of jurisdiction will be that of the place of business of Pulcher.
In case of dispute regarding the content, interpretation and performance of the contract, Pulcher, if necessary and at its discretion, will help to resolve the dispute through an electronic (telematic) conciliation process. In this case the Customer will be contacted via email by Pulcher or directly from the appointed electronic conciliator with a request for consent to electronic conciliation.
In any case, the customer can always go to court.
